ABMMA Online Terms & Conditions

Effective date: 8 February 2022

 

The Academy of Bioelectric Meridian Massage Australia (ABMMA) provides its online training course to you on the terms and conditions of this end user licence agreement (The Agreement). 

You must read this Agreement carefully before undertaking the online training.  By clicking (or ticking or signing) the ‘I agree’ you agree to accept the terms and conditions of this Agreement.

By clicking (or ticking or signing) the ‘I agree’ you also acknowledge and agree that ABMMA exclusively owns all:

  1. personal and moral rights in its online training courses as prescribed in the Copyright Act 1968 (Cth);
  2. rights of inventorship in its online training courses as prescribed in the Patents Act 1990 (Cth); and
  3. intellectual property rights in its online training courses.

 

1. INTERPRETATION

In this Agreement the following terms have the following meaning:

Online training: means all online training services and materials provided by ABMMA to you.

Intellectual Property Rights: means all copyright and related rights, patents, trademarks, trade names, design rights, copyright, confidential information, rights know-how and any other intellectual property rights, in each case whether registered or unregistered and including all applications for and renewals or extensions of such rights, and all similar or equivalent rights or forms of protection.

Licence: means the licence granted under clause 3.1.

Privacy Laws:  means the Privacy Act 1988, the Telecommunications Act 1997 and any other legislation, principles, industry codes and policies relating to the collection, use, disclosure, storage or granting of access rights to personal information, and words defined in privacy laws have the same meaning when used in this Agreement

 

2. YOUR USE OF THE ONLINE TRAINING

2.1 Your access to the online training courses is unlimited to you.  

2.2 You must keep your online training links, correspondence and passwords confidential.

2.3 You are solely responsible for ensuring that you have sufficient and compatible hardware, software and secure internet connectivity necessary to complete the online training courses.

2.4 You must use appropriate and up-to-date firewall and anti-virus software to protect your computer systems. We assume no responsibility for your use of our online training courses.

 

3. LICENCE OF THE ONLINE TRAINING COURSES

3.1 ABMMA grants you a licence to use and complete the online training courses in accordance with the terms of this Agreement (the Licence).

3.2 The Licence is revocable, non-exclusive, non-transferable and non-assignable.

3.3 The Licence is granted to you only. You must not share or allow access to the online training courses with any other person in any capacity whatsoever.

3.4 To the full extent permitted by law you must not:

a) record, reproduce, publish, distribute, communicate, rent, sub-licence and/or resell the online training courses;

b) use the online training courses to provide a service to any other person; or

c) modify, adapt, disassemble, de-compile and/or reverse engineer the online training courses.

3.5 You must use all reasonable endeavours to prevent any unauthorised access to, or use of, the online training courses and shall promptly notify ABMMA promptly of any unauthorised access or use.

 

4. PROPRIETARY RIGHTS

4.1 ABMMA owns all Intellectual Property Rights in the online training courses, materials and content. Other than as expressly set out in this Agreement, ABMMA does not grant you any Intellectual Property Rights in respect of the online training.

4.2 You must not remove any proprietary notices attached to the online training courses.

 

5. LIMITATION OF LIABILITY

5.1 You indemnify ABMMA against any and all financial liability, damages and losses you might incur as a consequence of your breach of this Agreement or misuse of the online training courses. 

5.2 ABMMA makes no warranty or guarantee that its online training courses will be uninterrupted, delayed or error-free and free from viruses or other harmful components.

5.3 To the extent possible at law, ABMMA will not be liable for any loss or damage, including loss or corruption of data or information or any other damages, charges or expenses arising out of use of the online training. 

 

6. DATA PROTECTION AND PRIVACY

6.1. ABMMA shall only collect and process personal data in accordance with its privacy policy, which can be accessed via the website. 

 

7. BREACH

7.1 ABMMA may suspend or terminate your access to the online training at any time if we reasonably suspect that you have breached any term of this Agreement.

7.2 If ABMMA terminates your access to the online training you must return and delete (as applicable all the online training materials that have been provided by ABMMA) and ABMMA reserves the right to withhold any certificate of completion.

7.3 You acknowledge that a breach of any of your obligations under this Agreement may result in ABMMA suffering loss and damage and that damages alone may be an inadequate remedy for ABMMA such that ABMMA is entitled to seek an interim interlocutory or permanent injunction against your breaches.

 

8. GOVERNING LAW AND JURISDICTION

8.1 This Agreement shall be governed by, and construed in accordance with, the laws of Queensland and Australia, and the parties irrevocably submit to the jurisdiction of the Courts of Queensland, Australia.

 

9. ENROLMENT POLICY

  • ABMMA provides a structured path to Bioelectric Meridian Therapy.
  • Our Basic Level 1 courses are designed for people of all backgrounds who are beginning their journey with this revolutionary therapy. Prior anatomical knowledge is not required however it is beneficial. We provide pre-course material to give students a basic knowledge of TCM principles.
  • We also provide Level 2 and Specialisation courses which provide students with in-depth knowledge  of body systems and treatment methods. These courses are ideal for the experienced Therapist who are looking for more advanced applications of BMT.

 

10. BOOKING CONDITIONS

  • All registrations must be accompanied by full payment of the course fee (inclusive of GST) to guarantee your place in a course.

 

11. COURSE CANCELLATION POLICY

  • If the registrant cancels their registration within 30 days prior to the course start date, 50% of the course fee and 100% of any equipment purchase will be refunded.
  • If the registrant cancels their registration within 14 days prior to the course start date, the course fee is forfeited and 100% of any equipment purchased will be refunded.
  • ABMMA reserves the right to cancel any course at any time, in which case all money already paid, will be refunded in full. The course may be postponed, in which case all money already paid will be transferred to the next occurrence of the course within 12 months or returned to the participant at their request. If there is no equivalent course held within 12 months, all money already paid will be refunded in full.
  • ABMMA will not be held liable for any loss incurred due to cancelation of any course by any party.

 

12. REFUND POLICY

  • If a student is not satisfied with the training received during a course conducted by ABMMA they may be issued with a refund of the course fee, the student must return any supplied products to ABMMA. This includes the certificate of completion.
  • By accepting return of the course fee the student indemnifies ABMMA against any loss, financial or otherwise incurred by the student through their attendance of the course.
  • In no circumstances will ABMMA accept liability for loss or damage outside its control or not directly caused by ABMMA.

 

13. COMPLAINTS POLICY

  • All complaints made against ABMMA are taken seriously and will be addressed and resolved within 28 days of receipt.
  • Complaints must be made in writing and emailed to the Principal, Tracy Taulier at: [email protected]
  • You will receive an initial acknowledgement of your complaint within 4 business days of receipt.
  • Please include as much detail as possible regarding your complaint and attach any supporting evidence if possible.
  • At ABMMA we aim to maintain our position as Australia’s number one provider of Bioelectric Meridian Therapy training. We will take your complaints seriously and act upon them if validated.
  • Complainants will be updated regularly on the progress of their complaint by email.
  • ABMMA will keep your complaint for 5 years from the resolution date.
  • Should the complaint regard criminal behavior or a crime of any type, ABMMA will request permission from the complainant to contact the police.

 

14. APPEALS

  • The complainant can appeal the decision ABMMA makes about the complaint.
  • Appeals will be formally acknowledged within four business days, in writing.
  • If you feel that your complaint, and appeal, has not been addressed to your satisfaction, your complaint should then be forwarded to your Professional Association, or to the Health Ombudsman (HCCC) in your state or territory, or to the Australian Competition and Consumer Commission (ACCC) in your state or territory.

 

15. ON-SITE TRAINING 

  • ABMMA takes reasonable care when scheduling its training courses.  However, attendance on-site at training involves certain inherent risks.  Attendance at this course requires you to indemnify ABMMA and its representatives against these risks by agreeing to these Terms. To the extent possible at law, you agree to unconditionally and irrevocably indemnify the ABMMA and its representatives against any and all claims, liabilities, damages and losses you might incur as a consequence of attending this course.

  • You acknowledge that attendance at this course is voluntary and that you are in good health with no physical or mental condition that would create a risk to health and safety by attending this course.
